Please note that as of 25.02.22, the Stage 1 Gateway has been reopened. In the first instance, please refer to briefing dated 25.02.22 to determine next steps, dependent of whether progression to Stage 1 is for the first time, or a return to this Stage. Stage 1 Consultation Requirements with the NTUS Unions (24.09.21 & updated 25.02.22)

The below document has been published to remind establishments of the requirements for Stage 1 consultation with the NTUS unions, if progressing to Stage 1 for the first time. It’s purpose is to set out the process and channels for consultation where there is not a local representative in place, and to guard against failure to consult as per the mechanics set out in the 2021 Stage 1 Gold Briefing. It provides a list of contact details for regional NTUS representatives and also a reminder of the processes in place. In particular

  • Trade Unions should be given a minimum of 5 days to formally consult
  • Establishments must consult with Trade Union representatives as early in planning as possible
  • There should be continued engagement on local risk assessments and safe systems of work and representatives will be engaged throughout the planning process
  • 5 days is the formal final sign off period.

The briefing also includes further guidance on the documentation that establishments should be sharing with NTUS representatives to inform the consultation. Anecdotal feedback has highlighted that in some circumstances establishments have shared Stage 2 and 3 documents such as EDMs rather than those required for Stage 1 and so establishments are asked to refresh their understanding prior to beginning consultation.

Prisons who have previously progressed to Stage 1 should engage with Unions using previously consulted progression paperwork. However, a full consultation will not be necessary.

Please note that as per the GOLD Brief from 17.09.21, the Assurance Statement does not have to be completed for Stage 1 progression until further notice.

24/09: Following requests from colleagues on more clarity on how to fill out the Stage 1 Regime Summary Document, the above document has been produced that offers additional guidance on this. Whilst the sign off of this takes place between a governor and PGD and that’s how the information included will be assessed , the suggestions in the attached should be considered as good practice when completing the form.
